Complex Acute Fracture, Epidural Hematoma, Mental Anguish, Loss of Companionship and Society


$650,000 - Doris Mcmillian v. Arctic Enterprises, Inc.
On 10/7/2005, claimants' decedent Ann Doris McMillian, 83, who was wheelchair-bound and lived in a nursing home , used by Citizen Care Ambulance Service to travel to a doctor appointment. A Citizen Care employee failed to fasten Doris McMillian's seat belt. While in Waxahachie on the way to the doctor, the driver missed an exit and braked suddenly. McMillian was ejected from the wheelchair and sustained fatal injuries.

McMillian’s estate, widower and two sons asserted negligence against Arctic Enterprises Inc., operating as Citizen Care Ambulance Service, Dallas, regarding the driver’s failure to fasten McMillian’s seat belt.

Injuries/Damages: Death
McMillian severely lacerated her forehead and sustained a complex acute fracture of the C2 body. She also sustained an epidural hematoma at the C2-3 articulation and extending to the C4-5 junction. She died at the hospital 13 days after the accident.

McMillian’s widower and two sons claimed wrongful death damages, including mental anguish and loss of companionship and society. The estate claimed medical bills of $75, 886 and the funeral and burial expenses of $12,156.

Regarding any future wrongful death damages, Arctic noted that McMillian was 83 at the time of the incident. In addition Artic contended that McMillian was given large dosages of pain medication prior to her death, and this medication was effective in reducing her pain.

Result:
Arctic settled for $325,000 to the widower for himself and the estate and $325,000 total to the sons.

A Waxahachie woman injured in a March 1991 car wreck was awarded a $1 million agreed judgment in Ellis County District Court.

Plaintiff attorney John Mallios said the judgment is the largest personal injury judgment he has seen in Ellis County.

Brenda Hancock received extensive injuries when her car was struck by a truck driven by an employee of The Greenery, a greenhouse in Waxahachie. According to Mallios, the driver ran a red light at the intersection of Highway 77 and FM 387 and hit the woman’s car.

Mallios said the woman was in a coma for several days, and she suffered from a broken pelvis, crushed sciatic nerve and bladder damage. He said she also has a permanent limp and must walk with the aid of a cane.

Her 12 year old son was also in the vehicle, but he was not hurt as seriously. "They used the Jaws of Life for two or three hours to get her out of the car,” Mallios said. “It was a horrible thing for that little boy to have to sit and watch."

The civil suit, requesting more than $1 million, was filed six months after the accident. View article here.

Dallas – A 31 year old Arlington man has been awarded $3.4 million in a product-liability case he filed against the manufacturer of a forklift he fell from almost five years ago.

A U.S. district judge ruled Wednesday that Tommy Card’s fall could have been prevented had Taylor Machine Works of Mississippi installed a handrail on the equipment.

The manufacturer of the forklift argued that a roll bar in the forklift’s cab was designed to be a grip.

Card was employed by Goodyear in Dallas to inspect tires on construction equipment in Irving. As he checked the fleet on an August night in 1987, he said, he discovered two flat tires on a forklift. Card said that as he stepped of the forklift, lost his footing and fell four feet, hitting his lower back. After a few minutes, he got up, he said. He and a co-worker changed the tires, a job that took three hours.

When he sat down in his service truck to rest, he said, he realized something was wrong. "I couldn’t move. I was scared," Card said. He said he managed to drive to a nearby hospital, where he began sounding his horn because he couldn't get out. A disc in his back was crushed. His medical bills have totaled $203,000, he said.
